THE LAW IS AN ASS - GERARD BADEN-CLAY IS GUILTY OF MURDER
The law in an ass, and anyone, including Gerard Baden-Clay's lawyers and the three Queensland Court of Appeal judges who quashed his murder conviction, are an even bigger ass if they think his crime only constitutes manslaughter.
For crying out loud, what planet are these people on? Firstly, besides the crime itself, Baden-Clay is now exposed as having committed perjury under oath in the original Supreme Court trial when he denied any knowledge of or involvement in the killing of his wife Allison Baden-Clay.
Regarding his crime, Baden-Clay, based on corroborated and extremely strong circumstantial evidence, was proven to have killed his wife by strangulation. Choking someone to death could rarely be classed as manslaughter. That's because manslaughter is defined as killing someone in an unintentional and unpremeditated manner.
The deep lacerations on Gerard Baden Clay's face were the result of Allison Baden-Clay digging in her fingernails in a desperate last bid to save her life while he had her in a choker hold. Does that sound like an accident to you?
If Gerard Baden-Clay's crime wasn't "pre-meditated" then why did he very obviously appear to have a well executed "logistics plan" in place to dispose of Allison's body "neatly" under a bridge kilometres away from the family home where he killed her?
If he stuffed up, lost the plot, and killed her in a moment of madness, but was genuinely remorseful, then Baden-Clay would not have attempted to relocate Allison's body and would have called the police that night to fess up. Had it played out like that then it would have constituted manslaughter. But it didn't, and that's why he's guilty of murder.
